Privacy Policy


Apparel Media Group, LLC, d/b/a Pear ("Pear", "we" or "us") understands that security and privacy are important issues for visitors to and users of www.pearup.com and associated subdomains, such as blog.pearup.com (collectively, the "Site"). Pear helps brands and communities build meaningful connections through sponsorship programs, gifts and awards, and more. We're passionate about Marketing that Matters. The following Privacy Policy (the "Policy") sets forth Pear's privacy practices regarding its collection, use and sharing of the information that Pear gathers via the Site and about users of the Site.

By using the Site and providing us with information, including Personal Information, you consent to our use of such information as described in this Policy. Your use of our Site, and any dispute over privacy, is subject to this Policy and our Terms of Use, including its applicable limitations on damages and the resolution of disputes. Our Terms of Use are incorporated by reference into this Policy.

Collection of Information

We may collect information directly from you, automatically through your use of our Site, and from third-party sources. We may combine all of the information we collect about you.

Information Collected Directly from You. You may be asked to provide certain information that can personally identify you as an individual, such as your name, email address, phone number or organization's name (collectively, "Personal Information"), for example, to create an account on the Site or participate in the sponsorship opportunities offered therein. We will also collect any other information that you choose to provide to us through our Site (eg your name and email address if you comment on a blog post).

Group Information. We may collect information about you from other users and/or email providers. Users have the ability to create groups of individuals within the Site (each, a "Group"). When creating a Group, a user may be asked to voluntarily provide information about the Group and its individual members, including the age range of Group members, the Group membership size, and email addresses of other members of the Group (collectively, the "Group Information"). Users may choose to import their contacts from an email provider, such as Google. If you provide us with email addresses of others through our Site, whether directly or by importing from a third party, please note that the recipients of communications that we send on your behalf may have access to information about you, such as your name and email address. We may also send follow-up reminders to persons you email through our Site.

Information Collected About You from Third Parties. We may also collect information about you from other third parties. For example, we may collect information about you from social networking platforms, such as your user name, profile picture and friends from Facebook. We may also collect demographics information from public sources and from third-party data and analytics companies. We use this information to enhance the data we already have.

Information We Collect Automatically. We may automatically collect information about your use of our Site and your sponsorships, including but not limited to your Internet protocol ("IP") address, the type of web browser you are using; the website that led you to our Site; the website you go after leaving our Site; the pages you view on our Site; and the dates and times you access our Site.

Information Collected About You from Third Parties. We may also collect information about you from other third parties. For example, we may collect information about you from social networking platforms, such as your user name, profile picture and friends from Facebook. We may also collect demographics information from public sources and from third-party data and analytics companies. We use this information to enhance the data we already have.

Information We Collect Automatically. We may automatically collect information about your use of our Site and your sponsorships, including but not limited to your Internet protocol ("IP") address, the type of web browser you are using; the website that led you to our Site; the website you go after leaving our Site; the pages you view on our Site; and the dates and times you access our Site.

User-Generated Content

You may upload or transmit text, graphics, photos, videos, or other materials to the Site ("Content"), including without limitation a profile picture, picture of your Group, comments, reviews, or status updates. If you post Content on our Site, the Content, as well as other information, such as your user name and profile picture, may be available to all visitors to our Site, and we cannot prevent such information from being used in a manner that may violate this Policy, our Terms of Use, the law, or your personal privacy.

Use of Information

Pear may use your information, including Personal Information and/or Content, as follows:

Account Administration. Pear may use your information to administer your and/or your Group's account and facilitate sponsorships.

Marketing and Advertising. Pear may use your information to send special offers, product information and other marketing or promotional communications from Pear and from other third parties. In order to tailor our communications to you, we may combine the information we collect from you with information (eg, demographic information) that we obtain from third-party sources.

Communications. Pear may use your information to communicate with you about your account, sponsorships, or use of our Site, provide you with news or other information we think may interest you and for other informational purposes. Customer Support. Pear may use your information to provide our Site and services, to respond to questions or requests from you and for other customer support purposes.

Research and Analytics. Pear may use your information to analyze how customers interact with our Site and the services our customers use, as well as for other research, analytical, and statistical purposes.

Protecting Rights and Interests. Pear may use your information to protect our rights and interests as well as the rights and interests of our customers and the public.

Legal Compliance. Pear may use your information to comply with legal or regulatory obligations, including informal requests from law enforcement or other governmental authorities.

Combination of Information. Pear may, on occasion, combine information we collect directly with information that we collect from other sources. We may also combine information collected about you with Group Information, Content, and information from third parties in order to identify potential marketing and sponsorship opportunities to Group members.

Information Sharing

Pear may share your information, including Personal Information and/or Content, with third parties in the following contexts:

Service Providers. We may share your information with third-party service providers. For example, we may use service providers to send mail, provide search results and links or provide other customer services related to sponsorship opportunities in which you have opted to participate.

Sale or Acquisition of Assets. If Pear becomes involved in a transaction involving the sale of its assets, such as a merger or acquisition, if Pear is transferred to another company, or in the event of a bankruptcy, Pear may disclose and/or transfer the information we collect about you and/or Content as part of the transaction. If the surviving entity in that transaction is not Pear, the surviving company may use the information we collect about you pursuant to its own privacy policies, which may be different from this Policy.

Affiliates. Pear may share the information we collect about you with any current or future parent company, affiliates or subsidiaries. For example, we may share your information with CustomInk, LLC, whose privacy policy is located here. Such corporate affiliates may use your information for their own purposes, which may include marketing purposes.

Our Partners. You may opt in to sharing your information with our partners who offer sponsorship opportunities to users and Groups on the Site. Our partners may use this information for their own purposes, including to contact you about sponsorship opportunities or for other direct marketing purposes.

Other Unaffiliated Third Parties. As noted above, Pear may use the information it collects about you to send you certain marketing offers on behalf of other unaffiliated third parties or so that those third parties may send you marketing offers directly.

To Protect Pear and Others. Pear may share your information if required or permitted to do so by law; for fraud protection and credit risk reduction purposes; to protect and defend the rights or property of Pear or the users of the Site; to protect the safety of Pear or its employees or a member of the public; to comply with a judicial proceeding, court order, or legal process; or as evidence in litigation in which we are involved.

Legal Compliance. We may share the information we collect about you to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; in response to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a government official.

Aggregate or Anonymous Information. We may share anonymous or aggregate information about Pear users to third-party companies. For example, we may share anonymous or aggregate information to inform a third party's decision on whether to participate in the Site as a sponsor (ie informing a sports-related business about the number of nearby sports-related teams/groups seeking sponsorship on the Site) or to place ads on our Site, on Apparel Media Group services and websites, or on other websites. These companies may use such information about your visits to the Site and other websites to provide sponsorship opportunities or advertisements on the Site and other websites.

Cookies and Other Tracking Mechanisms

We may automatically collect information through the use of common information-gathering tools such as web beacons, cookies and server logging – as well as new tracking technologies in the future as technology evolves.

Cookies. A cookie is a small string of text that a website can send to your browser which helps the website remember and customize your visit. For example, cookies allow us to tailor the Site, and the content or offers we display to you, in order to better match your interests and preferences. With most Internet browsers or other software, you can erase cookies from your computer hard drive, block or disable cookies or receive a warning before a cookie is stored. Please refer to your browser instructions to learn more about these functions. If you reject cookies, functionality of the Site may be limited, and you may not be able to take advantage of many of the Site's features. Web beacons/clear GIFs. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, which are embedded invisibly on web pages or in our emails. We or our service providers may use clear GIFs (also known as web beacons, web bugs or pixel tags), in connection with our Site to track the activities of visitors to our Site, help us manage content, and compile statistics about usage of our Site. We or our service providers may also use clear GIFs in emails to our users, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Third-Party Analytics. We may use applications, servers and other technology provided by third-party companies, such as Google Analytics, to help us improve our Site, performance, and user experiences. These entities may use cookies and information-gathering tools, such as web beacons or Flash LSO, to perform their services.

Do Not Track Disclosure

Interest-Based Advertising

We may use third parties such as network advertisers to serve advertisements on our Site and on third-party websites or other media (eg social networking platforms). This enables us and these third parties to target advertisements to you for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party's specific privacy policy, not this one. We may provide these third-party advertisers with information, including Personal Information, about you.

Users in the United States may opt out of many third-party ad networks. For example, you may go to the Digital Advertising Alliance ("DAA") Consumer Choice Page for information about opting out of interest-based advertising and their choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative ("NAI") Consumer Opt-Out Page for information about opting out of interest-based advertising and their choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies' delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. Privacy of Children

Our Site and services are not targeted to children under thirteen (13) years of age, and we do not knowingly collect any Personal Information from children under 13. If we discover that we have inadvertently collected Personal Information from a child under 13 years of age, we will promptly take all reasonable measures to delete that data from our systems.

Your Choices

Account Information. If you ever wish to access your Personal Information, update your Personal Information or cancel your account, please contact us at support@pearup.com or through the contact information below. Please note that we may maintain copies of your information and Content even after you have updated the information or canceled your account.

PearUp Communications. We may send periodic promotional or informational emails to you, about Pear and other third party information and offers. In the event you do not wish to receive such emails from Pear, you may opt out of such communications by following the opt-out instructions contained within the body of any email message you receive or emailing us at support@pearup.com with the information necessary for us to process a request to opt out of such emails. It may take us up to ten (10) business days to process your opt out request. Even if you have opted out of receiving marketing and promotional emails from us, we may still send you transactional emails, such as emails about your account or the services you have requested from us.

Third-Party Communications. You may also opt out of our sharing your information with third parties for their marketing purposes on a going forward basis by emailing us at support@pearup.com. Please note that once we have shared your information with a third party, such information is subject to that third party's privacy policies and practices.

Interest-Based Advertising. Please see our Interest-Based Advertising section above for more information about your choices regarding online interest-based advertising.

Your California Privacy Rights

If you are a California resident, you may request a list of certain third parties to which we have disclosed personal information, as defined in California's "Shine the Light" law (Cal. Civ. Code § 1798.83), about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by contacting us at: support@pearup.com. Please allow up to thirty (30) days for a response.

External Links

The Site may contain links to other sites on the Internet that are owned and operated by third parties. Pear is not responsible for the collection or use of information about you at any third-party sites. Your use of an external website or any informational content found on an external websites is subject to and governed by the terms and guidelines of those website(s). Pear does not endorse or make any representations or warranties concerning, and will not in any way be liable for, any informational content, products, services, software, or other materials available on an external website, even if one or more pages of the external website are framed within a page of this Site.

Security

We have taken steps to protect information we collect about you. Unfortunately, no safeguards or processes can be guaranteed to be 100% secure. We cannot ensure or warrant the security of any such information, and you provide such information at your own risk. If you have an account with us, you should take steps to protect against unauthorized access to your account by, among other things, choosing a robust password that nobody else knows or can easily guess and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
